Privacy Policy

1. Introduction

IN-FOMO. ("we," "our," or "us") is committed to protecting your personal data. This Privacy Policy explains what data we collect, why we collect it, how we use it, and what rights you have under the General Data Protection Regulation ("GDPR", EU 2016/679) and other applicable data protection laws.

As an EU-based service provider, we do not have a statutory obligation to appoint a Data Protection Officer at this stage, but you may reach us at the above address for any data-protection matters.

3. Data We Collect

3.1 Data You Provide Directly

  • Name and email address (contact and blog contact forms)
  • Message content — your project description or inquiry

3.2 Data Collected Automatically

Only after you give consent (see Section 4):

  • Pages visited, session duration, referral source (analytics)
  • Browser type, operating system, screen resolution
  • IP address (anonymised before storage by Google Analytics)
  • UTM campaign parameters

We do not collect sensitive personal data (health, political opinions, racial origin, etc.).

4. Legal Basis for Processing (GDPR Art. 6)

  • Consent (Art. 6(1)(a)): Analytics, marketing, and functional cookies; promotional communications. You may withdraw consent at any time via our cookie banner or by emailing info@in-fomo.com.
  • Contract (Art. 6(1)(b)): Processing your contact form submission to respond to your project inquiry.
  • Legitimate Interests (Art. 6(1)(f)): Ensuring website security, preventing fraud, improving our services. We conduct a balancing test before relying on this basis.
  • Legal Obligation (Art. 6(1)(c)): Retaining records required by law.

5. How We Use Your Data

  • Responding to your inquiries and delivering requested services
  • Sending project updates and administrative communications
  • Improving website performance through aggregated analytics
  • Complying with legal obligations

We do not sell your personal data to third parties. We do not use your data for automated decision-making or profiling with legal or similarly significant effects.

6. Data Retention

  • Contact form submissions: retained for up to 2 years from last contact
  • Analytics data: up to 14 months (Google Analytics default)
  • Cookie consent records: 1 year

7. Third-Party Processors & International Transfers

We share data with the following processors only to the extent necessary:

  • Google LLC (Google Tag Manager / Analytics) — EU Standard Contractual Clauses
  • Sanity.io (CMS infrastructure) — EU Standard Contractual Clauses
  • Telegram (contact form notifications) — message content only, no persistent storage

Where data is transferred outside the EEA, we rely on the European Commission's Standard Contractual Clauses (SCCs) as the transfer mechanism.

9. Your Rights Under GDPR

  • Right to Data Portability (Art. 20): Receive data in a machine-readable format
  • Right to Object (Art. 21): Object to processing based on legitimate interests
  • Right to Withdraw Consent (Art. 7(3)): At any time, without affecting prior lawful processing

You also have the right to lodge a complaint with a supervisory authority — in Poland: the President of the Personal Data Protection Office (UODO).

10. Data Security

We implement appropriate technical and organisational security measures (encryption in transit via TLS, access controls, regular security reviews) to protect personal data against unauthorised access, loss, or disclosure in accordance with GDPR Art. 32.

In the event of a personal data breach that is likely to result in a high risk to your rights and freedoms, we will notify you without undue delay as required by GDPR Art. 34.

11. Changes to This Policy

We may update this Privacy Policy when our practices change or when required by law. The "Last Updated" date will reflect any changes. Where changes are material, we will provide prominent notice and, where required, re-request consent.
